AlumniSites — Terms of Service

1. Acceptance of Terms

By accessing or using any website hosted by AlumniSites ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. AlumniSites is operated as a sole proprietorship ("we," "us," or "our").

2. Description of Service

AlumniSites provides hosted alumni community websites for schools and educational institutions. Each school site ("School Site") is operated on behalf of a school or alumni organization ("School Administrator"). AlumniSites provides the platform; School Administrators are responsible for managing their communities.

3. Eligibility

You must be at least 13 years of age to use the Service. By registering, you represent that you are at least 13 years old and that all information you provide is accurate and truthful.

4. User Accounts

    To access certain features, you must register for an account. You are responsible for:
  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Content

You retain ownership of content you submit to the Service ("User Content"), including posts, photos, and profile information. By submitting User Content, you grant AlumniSites and the relevant School Administrator a non-exclusive, royalty-free license to display and distribute that content within the Service.
    You agree not to submit content that:
  • Is false, misleading, or defamatory
  • Infringes any third-party intellectual property rights
  • Contains harassment, hate speech, or threats
  • Violates any applicable law or regulation
  • Contains spam or unsolicited commercial messages
We reserve the right to remove any User Content that violates these Terms.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

7. Communications

By registering, you may receive transactional emails related to your account (such as password resets and verification emails). You may also opt in to receive birthday greetings, news, and event notifications. You may update your email preferences at any time from your account dashboard.

8. Prohibited Conduct

    You agree not to:
  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Scrape, harvest, or collect information about other users without consent
  • Impersonate any person or entity
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload viruses or other malicious code

9. Intellectual Property

The AlumniSites platform, including its design, software, and content (excluding User Content), is owned by AlumniSites and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Third-Party Services

The Service may contain links to third-party websites or services. AlumniSites is not responsible for the content or practices of any third-party sites. Your use of third-party services is at your own risk and subject to their respective terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ALUMNISITES DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALUMNISITES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless AlumniSites and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the effective date and, where appropriate, by email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
